  1. SUMMARY

The quarter April – June 2008 was quite promising for CIRC. The institute was successful in raising initial funding to cover the start up cost to some extent. Nandan Nilekani, Infosys has promised to contribute upto Rs 1 crore, provided CIRC is able to raise a matching amount by October 2008. Further details are discussed in the report under Funding. During this period a training workshop was organised in Ethiopia on Competition Policy and Law. In addition to the above, CIRC has developed and submitted proposals on undertaking capacity building initiatives in various new sectors such as Contract Management & Negotiations and PPPs.

  1. INFRASTRUCTURE

2.1) All necessary formalities have been completed including opening of a bank account and a registration certificate has been received. Further, an application and other requisite formalities/documentation for registration under Section 12A and 80 G of Income Tax Act has been initiated and completed.

2.2) CIRC hired office premises (B-2, Greater Kailash Enclave-II, New Delhi 110 048) in New Delhi and has commenced its operations. Few support staff have been put in place to start the operations.

2.3) On the issue of land, the Government of Rajasthan has agreed to offer 5000 sq mtrs land costing approximately 87lac in an institutional area with an easy access to all the necessary infrastructural facilities.

  1. GOVERNANCE

3.1) Governing Council: The third meeting of the GC is scheduled for August 11, 2008 at the CIRC’s Delhi office. The agenda for this meeting was discussed during the ninth Managing Committee meeting held on April 18, 2008. Preparations are underway for the said meeting.

The third meeting for the GC has been proposed for August 11, 2008. The agenda for this meeting would be discussed during the IX Managing Committee meeting scheduled for April 18, 2008.

3.2) Managing Committee: The ninth MC meeting was held on April 18, 2008 at Jaipur. There was a discussion regarding finding a suitable candidate for the post Director/Dean for running the institute. It was opined by the members that either one of them has to be in place soon in order to kick start the operations in full steam.

3.2.1) Key issues that emerged from the above-mentioned meeting:

a) Director/Dean/Faculty: Efforts are on to identify them. Names that were suggested during the meeting as well as by the GC members are being followed up rigorously. There was a suggestion in the meeting to revise the profile of the director.

It was agreed in the MC meeting, that the institute should have a dean who would focus on the academic activities of the institute. It was recommended to recruit someone with a strong academic background.

As reported earlier, Shri Sudhir Krishnaswamy is available as part-time faculty, while search for full-time faculty continues.

b) Course structuring: It was decided in the meeting that CIRC should have certain courses lined up to start with instead of waiting to have the Director in place. Two proposals- one on PPPs and another on Contract Risk Management have been submitted to Department of Economic Affairs, Ministry of Finance. These have been discussed in the previous reports.

  1. FUNDING

4.1) Additional Central Assistance

One-time grant under Additional Central Assistance (ACA) would be sought once CIRC acquires the land. (See para 2.3 for details on the land issue)

4.2) Funding under the MPLAD Scheme

Funding under Member of Parliament Local Area Development (MPLAD) scheme is conditional to acquiring land and is restricted to be used for asset creation only. Efforts will be made subsequently.

4.3) Friends of CIRC

Under the ‘Friends of CIRC’ (FoC) network led by IDFC, CIRC has been able to secure bridge funding against the Start-up Cost proposal. Letters of request have been sent to potential donors in Mumbai and elsewhere under the FoC network. List is annexed at Annexure 1.

On June 24, 2008 CIRC was invited to make a presentation by Nandan Nilekani, CEO & MD, Infosys Techonologies Ltd. As a result of the presentation, he has committed to contribute up to Rs 1 crore to support CIRC subject to it raising a matching amount of Rs 1 crore by October 31, 2008. Progress regarding funding is as follows:

Payments received before June 26, 2008: IDFC (15,00,000); HDFC (10,00,000); and CUTS International (20,00,000) i.e. total 45,00,000 (INR)

Payments received after June 26, 2008: ICICI Bank (10,00, 000) Under this clause, CIRC is still short of Rs 90,00,000 in order to meet the condition set by Nandan Nilekani. Rigorous efforts are being done to raise the matching amount.

4.4) Bilateral Donor Agencies

The funding proposal will be prepared and be ready for approaching the donors after the recruitment of Director has been successful.

  1. INTELLECTUAL RESOURCES

5.1) Visiting faculty and subject-expert group jointly formulate the intellectual resources of the institute. Their contributions are sought from time to time and they are kept updated on the progress of CIRC. To mention one such contribution, Allan Fels, visiting faculty member would be delivering a talk on “ How India should deal with Abuse of Dominance and Cartel Busting – Experiences from Across the Globe”, during his visit to India in July.

Subject expert groups have been formulated to provide guidance in structuring of the course material and modules. Their advice is sought on project proposals; contribute in the newsletter CIRCular by way of write-ups; comment on the event reports received after the training programmes in order to evaluate the effectiveness and usefulness of the trainings and how to improve and do better in the future.

6.2) Newsletter – CIRCular

CIRCular for the period April to June, 2008 has been published and is annexed with this report. The issue carries a special article on “Capacity Building: It’s an Industry” by Shri B Ramalinga Raju, Founder and Chairman, Satyam Computer Services Ltd.

6.3) Marketing

As mentioned in previous reports, marketing approach remains the same. These include: advertising through Internet to clientele as per the database; write-ups and discussion forums (Registration in the group can be done at: circ-forum@googlegroups.com); brochures, inserts, event-specific fliers, nomadic stand; press/news releases, etc. Extensive marketing tools would be utilised once funding is available.

6.4) Major Activities

During this quarter one training programme was conducted, while preparation and planning for other events/activities is going on in a continuous process.

6.4.1) Training Seminars
CIRC has so far organised 18 training programmes, two panel discussions and one international research symposium till date. A combination of Indian and international resource persons have contributed to these events.

  • A training workshop was conducted by CIRC from May 12-16, 2008 at Addis Ababa, Ethiopia. CUTS Centre for Competition, Investment and Economic Regulation (C CIER) and Ministry of Trade and Industry, Ethiopia were the co-organisers of this training workshop entitled, 'Competition Law Enforcement for Ethiopia’ (CPS.06). This workshop was meant mostly for members and staff of the Trade Practice Investigative Commission (TPIC), Ethiopia, though the ministry also invited other government departments, select academics, consumer organisations and media to the event.

6.5) Events Planned

Academic Lecture on “How India should deal with Abuse of Dominance and Cartel Busting - Experiences from Across the Globe” by Allan Fels, Dean of the Australia and New Zealand School of Government (ANZSOG), Australia and Former Chairman of the Australian Competition and Consumer Commission (ACCC)

Orientation programmes on PPP for Indian Railway senior management officials. CIRC in collaboration with IDFC and ITS would be offering these trainings.
